Article 1 Definitions:

Article 3 Applicability:
These terms and conditions apply to every offer and / or quotation, as well as to every agreement between Lifemoments.nl and the customer, as well as to the implementation of the agreement.

Article 4 Offers, quotations and orders:
All offers shown on the website are valid during the period that they are shown on the website and the relevant product can be delivered by the supplier. Unless explicitly stated otherwise, products such as baths, washbasins, toilets, etc. are supplied without accessories such as taps, connecting pieces, etc., even if these are shown on the product page in the photo and / or drawing.

Product properties, sizes and weights, images and (technical) drawings are shown as accurately as possible. Lifemoments.nl is not liable for the consequences of errors and / or deviations therein.

The prices in the aforementioned offers, quotations and / or orders are exclusive of VAT, exclusive of statutory disposal fees and exclusive of shipping costs, unless stated otherwise. Prices for consumers are shown including VAT.

If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.

Article 5 Agreement:
The agreement is concluded when the customer has placed an order and Lifemoments.nl has sent the customer an order confirmation by e-mail.
The provisions of this article also apply in full and in full to orders and / or quotations that relate to products to be ordered and / or tailor-made especially for the customer.

Article 6 Delivery:
Lifemoments.nl will make every effort to deliver within the specified deadlines. However, the delivery times stated on the site or in the quotation are never strict deadlines.
Lifemoments.nl is not liable for any exceeding of a delivery period.

If a delivery time indicated on the site or in the quotation is exceeded by more than one month, the customer is entitled to cancel the order by registered letter. However, the customer must always give Lifemoments.nl the opportunity to deliver within ten days after receipt of the registered letter.
The customer has the choice to pick up the ordered products himself in the warehouse of Lifemomenst.nl or have the ordered products delivered to the agreed delivery address.

If the customer refuses to cooperate with a delivery on a normal working day within normal working hours, Lifemomenst.nl will send the customer a written reminder. If the customer has not responded within 14 days after the date of the written reminder and / or has not cooperated with the delivery, Lifemoments.nl is entitled to dissolve the agreement out of court. The customer then owes a compensation to Lifemoments.nl in the amount of 50% of the amount of the purchase price, to be increased by the statutory interest from the day of the dissolution of the agreement.

Delivery takes place exclusively at the (first) front door on the ground floor; any vertical transport must be provided by the customer himself.

Article 7 Payments:
Lifemomenst.nl accepts the following payment methods:
• iDeal
• Bancontact / Mister Cash
• Bank transfer

The bank transfer must be received at least 3 days before delivery on the bank account of Lifemoments.nl.

Article 8 Complaints:
The customer must check the delivered product (s) immediately upon delivery for visible defects and / or the delivered items correspond to the order confirmation.
Complaints about visible defects and / or deliveries that do not correspond with the order confirmation must be reported in writing to Lifemoments.nl within 48 hours after delivery. Reports outside this period will not be processed.

If the customer makes use of his right of withdrawal, the costs of the return shipment are for his account. Any damage that occurs during the return shipment is for the account of the customer. If the customer has paid an amount, Lifemoments.nl will refund the amount to the customer within 30 days after the return of the product (s).

Article 10 Cancellation:
When the customer has placed an order and wishes to change or cancel it, the customer must notify Lifemoments.nl of this within 24 hours after placing the order and confirm this by email. After this period or if the article has already been shipped, orders can no longer be changed or canceled.

Article 11 Returns:
Lifemoments.nl only needs to accept returns that:
• Entirely complete in its original condition and in the original undamaged packaging.
• Unused and clean.
• Have not been mounted and / or installed.

Article 12 Warranty:
A 2-year warranty is given on the products delivered by Lifemoments.nl.
However, if a shorter warranty period is observed by our suppliers / manufacturers, that shorter period applies as the warranty period for the customer.
The customer will never be able to invoke the warranty if the defect has arisen as a result of incorrect assembly and / or improper use. The warranty will also lapse if the customer has made changes to the product.
The obligations arising from the warranty never go beyond what the supplier / manufacturer is obliged to do under the warranty conditions used by the supplier / manufacturer.

Article 13 Liability:
If the product delivered by Lifemoments.nl is defective, the liability towards the customer is limited to what is determined in these terms and conditions under article 10, on the understanding that the obligation to pay compensation is in all cases limited to a maximum amount of twice the purchase price. of the product that has resulted in damage.
Lifemoments.nl is never liable for damage caused by a defect within the meaning of the Product Liability scheme (Book 6, Title 3 Section 3 BW)
Nor is Lifemoments.nl liable if the damage is due to intent and / or gross negligence and / or culpable acts, or improper and / or improper use by the customer of the delivered product.

Article 14 Force majeure:
Lifemoments.nl is not obliged to fulfill any obligation arising from any agreement as referred to in these conditions. If Lifemoments.nl is prevented from doing so as a result of a circumstance that is not attributable to fault and cannot be or should be for its account by law or generally accepted beliefs, including all external causes foreseen or unforeseen or unforeseen, over which Lifemoments.nl cannot influence, including strikes in the company of Lifemoments.nl.
Lifemoments.nl can also invoke force majeure as referred to in the previous paragraph, if this force majeure arises after Lifemoments.nl should have fulfilled its obligations.
If the force majeure continues for more than two months, both parties are entitled to invoke the dissolution of the agreement.

Article 15 Disputes:
All disputes, even those that are only experienced as such by one of the parties, must be submitted exclusively to the competent court in the location of Lifemoments.nl, unless the subdistrict court has jurisdiction. Lifemoments.nl is however free to submit the dispute to the competent court under the law.

To every agreement between Lifemoments.nl and the customer, to the exclusion of any other law, only Dutch law applies.
